Welcome to Bamberg City Tour. These Terms of Use govern your use of the app and outline your responsibilities and limitations in relation to the app's features, including map functionality, analytics, in-app purchases, and other services provided.

By downloading or using Bamberg City Tour, you agree to these Terms, in addition to the standard terms and policies provided by the Apple App Store or Google Play Store. If you do not agree with these terms, please discontinue your use of the app.

General Disclaimer

The app provides suggested routes and maps for city navigation purposes only. These routes may not be accurate, complete, or reflect real-time traffic conditions. You agree to use these features at your own risk and discretion.

User Responsibility and Traffic Laws

Users are responsible for ensuring compliance with local traffic laws, rules, and regulations while following suggested routes. The app does not guarantee that suggested routes comply with local restrictions (e.g., road closures, restricted access). You must independently verify that the route is lawful and safe.

Limitation of Liability for Map Features

Bamberg City Tour is not liable for any damages, injuries, or incidents arising from reliance on suggested routes or map information. Mapbox may process location-related data to provide map functionality. Please refer to the Mapbox Privacy Policy for more details.

3. In-App Purchases Terms

General

The app offers an optional one-time in-app purchase that unlocks full access to all city tour content on a permanent basis. This purchase is not a subscription and does not renew automatically.

Access granted by this one-time purchase is tied to the user's app store account (Apple ID or Google account) and can be restored on compatible devices using the app's "Restore Purchases" functionality, subject to the policies of the respective app store.

The management of in-app purchases and entitlement restoration may be facilitated through RevenueCat. By making a purchase within the app, you acknowledge and agree to RevenueCat's billing policies, terms, and conditions, as well as those of the Apple App Store or Google Play Store.

Scope and Duration of Access

The one-time purchase grants access to all currently available city tour content within the app for an unlimited period of time, provided that the app and its services continue to be made available.

Bamberg City Tour does not guarantee perpetual availability of the app, its content, or supporting services. If the app is discontinued, removed from app stores, or its services are terminated, access to the app's content may no longer be possible, even if a one-time purchase was previously made.

Purchases and Billing

Prices for in-app purchases are displayed within the app and may change at any time. Users authorize Bamberg City Tour to charge the selected payment method associated with their app store account.

Refund Policy

All in-app purchases are final and non-refundable, except where required by applicable law or permitted by the policies of the Apple App Store or Google Play Store.

On iOS: Refunds can be requested through Apple's Report a Problem service.
On Android: Refund requests must be made through the Google Play refund process.

Bamberg City Tour does not issue refunds, credits, or exchanges directly and has no control over refund decisions made by the app stores.

Limitation of Liability for In-App Purchases

Bamberg City Tour is not liable for interruptions, errors, or loss of access related to in-app purchases caused by third-party services, including but not limited to Apple, Google, or RevenueCat. Use of the in-app purchase functionality is at the user's own risk.

4. Analytics and Data Collection

Google Analytics

The app uses Google Analytics to collect data about app usage and user interactions. This data is used to improve the app's functionality and user experience. No sensitive personal data is collected. Users can opt out of all analytics by toggling the opt-out option within the app settings.

Firebase Remote Config

The app uses Firebase Remote Config to dynamically update app features and settings. This functionality helps ensure a seamless user experience by enabling updates without requiring app reinstallation.

5. Disclaimer of Warranties

The app is provided on an "as is" and "as available" basis, without any express or implied warranties of any kind. Bamberg City Tour disclaims any warranty that the app will be uninterrupted, secure, or error-free or that its content will be accurate or reliable.

6. Limitation of Liability

To the fullest extent permitted by law, Bamberg City Tour and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of or inability to use the app. This includes issues, errors, or interruptions related to third-party services, including but not limited to Mapbox, Firebase, Google Analytics, and RevenueCat. Your use of these services is at your sole risk and is subject to their respective terms and policies.

7. Intellectual Property Rights

All content, trademarks, and intellectual property displayed within the app are the property of Bamberg City Tour or its licensors. Unauthorized use, copying, or distribution of any materials within the app is strictly prohibited.

8. User Conduct and Prohibited Activities

Users agree not to engage in any activities that may compromise the functionality or security of the app, including hacking, spamming, or illegal activities. Violation of these terms may result in suspension or termination of access.

9. Indemnification Clause

By using this app, users agree to indemnify and hold harmless Bamberg City Tour and its affiliates from any claims, losses, or damages arising from user actions or violation of these Terms.

10. Termination and Suspension of Accounts

Bamberg City Tour reserves the right to terminate or suspend user access if it deems that the user has violated these Terms or engaged in harmful activities.

11. Updates and Changes to Terms

We reserve the right to update these Terms at any time. Any changes will be effective immediately upon posting. Continued use of the app after changes implies acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany. Any disputes will be subject to the jurisdiction of the courts in Bamberg/Bavaria.

13. Severability Clause

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
